WASHINGTON (A)-The House yesterday passed a constitutional amendment that would insure against any break In the exercise of the powers and duties of the presidency. j The vote was 367 to 29. The amendment differs slightly from one passed 72-0 by the Sen- ate last February. Unless the Sen- ate accepts the House changes a compromise version will have to be worked out. When Congress completes ac- tion, three-fourths of the states must ratify the proposal before it can become the 25th Amend- ment to the United States Con- stitution. The legislation has two main purposes: to keep the office of Vice-President filled at all times, and to provide the means for hav- ing the powers and duties of a disabled President transferred to the Vice -President. On the first point, the amend- ment proposes that the President nominate a person to fill a Vice- Presidential vacancy, subject to the approval by majority vote of both houses of Congress. There were complaints from some members that the President should not be allowed to choose his successor. Written Declaration On the second point, when the President makes a written decla- ration to Congress that he is un- able to discharge his duties, the Vice-President takes them over until the President declares his ability to resume them. If the President does not make such a declaration, the Vice- President and a majority of the Cabinet may declare the Presi- dent unable to carry on, where- upon the Vice-President imme- diately assumes the powers of the office.
