Judge Frank A. Kaufman of U.S. District Court will hear ar- guments on whether the 113 men should be released. They contend their enlistment contracts were violated without due process of law undef the equal protection of the laws provision of the Fifth Amendment. ACTIVATED LAST MAY 'he men were members of the 1002nd Supply and Service Com- pany on inactive duty in Cleve- land when ordered tyoactive duty effective last May 13. Three days later, the unit moved to Ft. Meade, Md., as the 1002nd Com- bat Support Company. Contending the action was "void, invalid and without legal effect," the Ohioans brought suit1 last week against Secretary of De- fense Clark Clifford, Secretary of the Army Stanley R. Resor; Harold K. Johnson, Army chief of staff and the commanding of- ficers of Ft. Meade and the 1st Army, headquartered at Meade. NO OBLIGATION The petition to the court says3 each of the men enlisted in .thei Army reserve before Oct. 15, 1966, with an obligation to serve six years of inactive duty, and no more than 17 days a year on ac- tive duty, after serving on active duty for training. Otherwise, it said, they may be called to active duty "only in time of war or national emergency declared by Congress or , . . by the President after Jan. 1, 1953." The Ohioams contend the law makes a distinction between re- servists called up as a unit, as in their case, and those called up as individuals. It "credits individual reservists with previous active * duty for training, but does not so, credit members of a unit so or- dered," they said.
