performance will be decreed in all cases
in which the subject matter involved is
an object' of unusual distinction which
cannot be duplicated in the opens market.

a scintilla of doubt that both the afore-

This court will not hesitate to decree
specific performsance of the conmpact set
forth in plaintiff's bill on the ground
that it is contrary to public policy, for
there is ample precedent for the per-
formance -prayed for -in the bill. In rc
Griswold, 2 Practice Reports 317, is a
case ins point in which specific perform-
ance_ of a similar compact was decreetd
against the same defendants. The alle-
gations of the bill show moreover thsat
no inequitable, burden swill be placed ott
the defendants by a decree of specific
performance for the reason that the at-
tractions of Toledo appear amply suf-
ficienst to please the most diversifiedt

to be enforced, any objection which is
or may be urged on that acconit is so
frivolous that the court will dismiss it
