The act, which was passed in May of 1994 and goes into
effect April 1, 1995, prohibits lockouts by public school em
ployers and fines each party if found guilty of the act, Also,
certain issues would not be subject to collective bargaining.

"The feeling you get is that [PA 112] undercut ny fairnes
in it," bauster aid. "It s m lik there's negotiations and

PA 112 SA� THAT if on or both parties fails to ratify a
recommended settlement within 30 day after a m diator is
mutually agreed upon by both sides, the public school em
ployer can implement the last b t offer made. Dauster said
it is that clause which undercuts the union's bargaining power
since the school board may as well wait for the la t offer.
"Why should they bargain?" Dauster sid. "Where's the
pressure to bargain?"
The association is part of th Michigan Education As ocia
tion (MEA), Michigan's large t t acher's union.
"The MEA has a lot of cone rn about PA 112," said Pat
Dolan, director of commu nications for MEA. "It ha not gone
into effect yet and we can only speculate as to wh t i liabl
to happen."
Focus on the upcoming election has forced the MEA to wart
until later in the year befor it can look at the a in depth,
Dolan said.
