RESOLUT10N 94�003
WHEREAS, Benton Charter Township
("Township") is certified by the Federal
Communications Commission (" FCCIt)
to regulate the rates of Joppa Associ­
ates. L. P., doing business as Consoli­
dated Cablevision {"Consolidated "); and
WHEREAS, the Township has adopted
an Ordinance ("Ordinance") to prescribe
procedures for raterequlation r >nsistent
with the 1992 Cable Act and FCC Rules;
and
WHEREAS. Consolidated has the bur­
den of proving that its schedule of rates
and any increases therein comply with
the 1992 Cable Act and FCC rules: and
WHEREAS, on June 30..1994, Consoli­
dated filed with the Township a FCC
Form 1210 requesting an increase in
certain maximum permitted rates for
regulated cable service ("First Form
1210"); and
WHEREAS, the instructions to Form
1200 advise cable operations that "[y]OU
may begin using Form 1210 on July 1.
1994, to update your rates to reflect
changes that occurred during the sec­
ond quarter of 1994," which instructions
cable operators are required to follow:
and
WHEREAS. through July and ear1y Au­
gust of 1993. Consolidated's cable pro­
gram ming contained one (1) home
shopping channel: and
WHEREAS, In August 1993, Consoli­
dated added eight (8) additional shop­
ping channels, for a total of nine (9) such
channels: and
WHEREAS, the preceding actions were
taken in anticipation of rate regulation to
Increase Consolidated's revenues by in­
creasing the number of regulated chan­
nels times wrucn the maximum
permitted rate would be multiplied, while
not mcreasmq Consolidated's costs, due
to the fact that home shoppmq networks
pay cable operators to carry their pro­
gramming; and
WHEREAS, the FCC rules provide for
quarterly adjustments' of so-called exter­
nal costs and that such costs are re­
duced by a number of factors. including
revenues which cable companies re­
ceive from home shoppmq networks.
and
WHEREAS, in its diligent review of Con­
solidated's First Form 1210 filing, the
Township submitted data requests. pur-
WHEREAS, Consolidated did not com-

sponse refused to provide data relating

II :�EREAS. Consolidated is incorrect in
its interpretation of the FCC rules and it
cannot benefit at the expense of sub­
I scribers by using nine (9) home shop­
I ping channels to significantly increase its
regulated rates b charging the maxi-
mum permitted rate for each such chan­
nel, while at the same time refUSing to
offset against such rates the revenues it
receives from such channels; and
WHEREAS, on July 28, 1994, the Town­
ship. by resolution, rejected Consoli-
dated's First Form 1210 without preju­
dice because it was premature and be­
cause Consolidated failed to supply
necessary data on its home shopping
channel revenues; and
WHEREAS, on July 28, 1994, the Town­
ship also ordered Consolidated to file
additional information on its home shop­
ping channels in compliance with FCC
Rules, as set forth in the Township's data
request to Consolidated. in the event
Consolidated resubmitted its request or
in its future requests to increase certain
maximum permitted rates for regulated
cable programming services; and
WHEREAS, on August 5, 1994, Consoli­
dated filed with the Township a FCC
Form 1210 requesting an increase in
certain maximum permitted rates for
regulated cable services ("Second Form
1210"); and
WHEREAS. due to the continued failure
of Consolidated to supply the necessary
data concerning its nine (9) home shop­
ping channels, the Township cannot de­
termine whether or to what extent the
increase requested in Consolidated's
Second Form 1210 is correct: and
NOW, THEREFORE BE IT RESOLVED,
that due to Consolidated's failure to com­
ply with the Township's July 28, 1994
Order by supplying the necessary data

Consolidated has made it nnpossrble for
the Township to determine whether or to
what extent that the rate increase re­
quested In its Second Form 1210 is cor­
rect and in compliance with applic ble
law; and
