low Johnson to rescind a motion

ing authorizing the construction
of a city municipal complex on
the former Johnson site. The

Wainwright said it was illegal
to rescind a motion once it was
written in the minutes. Johnson
stated that she received legal ad­
vice that it was acceptable as
long as no work had been done.
Both Franklin and Johnson
charged it was irregular for indi­
vidual members of the council to
be singled out for suit, rather
than the city council as a body.
Johnson said, "We act as a
body. He cannot nit pick and pick
out three council members who
voted against him." Franklin
said the decision to deny Hender­
son and Hannah money was also
supported by Council President
Dwight Downes and his name
was on the letter authorizing the
City Treasurer and Clerk not to
pay.
Councilman Frank Ross was
not present at the meeting, she
said, and so could not vote either
way.
Franklin charged that she,
Johnson, and McClary were cho-
en for the suit, beeau they
often voted against the mayor on
other issues and that "we are not
rubber stamps."

sey Porter had hired an outside
attorney to sue the City Tress­

Franklin.
One part of the uit involv a
refusal by the City Clerk and
City Treasurer to pay John Hen­
derson and Tom Hannah for
work done for the city. Franklin
stated that the city council re­
fused to pay for the work, be­
cause it did not approve the
contract.
Wainwright said under the
city charter the mayor can
authorize expenses up to $2,000
without council .approval and,
