The Judiciary Committee needs to know the Judicial record of Smletanka. He is well known to African Americans In western Michigan. Under his reign as Berrien County Prosecutor, he turned the courts-into a "railroad station to Jackson" for Blacks. One case that shows clearly the questionable tactics of John Smietanka Is the Maurice Carter case. Carter is serving a life sentence for the shooting In 1973 of an off-duty Benton Harbor police officer. The officer, wounded superficlally,.clalmed the day of the shooting he could not Identify the assailant. TWo years later after Carter's picture was published on page one of the local paper, the officer picked Carter out of a lineup. Carter's court-appointed attorney never filed a motion for discovery and went to trial without the facts. The African American woman who clerked In the store where the shooting occured testlfed that Carter was not the assailant. White employees of Smletanka testified that Carter was the man. The ali-white Jury convicted Carter. . . A Southfield attorney, working for free out of conviction that Carter wa railroaded, has uncovered evldence of jury tampering In the Carter case. That discovery has prompted the national NAACP and the Benton Harbor City Commission to request an Investigation of charges of Jury tampering In the Carter case. Where do you fit In?
