323.2182, and Control Authority;
WHEREAS, th DWSD, operator of the POlW, pursu t
to 40 C.F.R. Part 403, Is r pon ble for enforcement of the
IIppI'OYed Pr treatment Program;

health, safety and general welter of the r Idents of the �

NOW, THEREFORE, In consldera on of the promise and
tt:te covenant herein made, the parties agr follows:
· 1. The City of Highland Perk hereby delegates
and 19os the right, privilege and authority to administer and
.moroe the Industrial pretreatment provisions of Its applicable
wastewater ordinance, as amended, to the BOARD with all
necessary powers attendant to that administration and enforce­
ment, Inoludlng but not limited to the power to adopt rules and
regulations for purpos consistent with aid ordlnanc ,and
federal and state pretreatment standards, statutes, rules, regul -
one and requlr ments, and the BOARD Is hereby designated
th duly-authortzed representative of the Clt¥ of Hlgblond Perk
for uch purposes under the powers of said ordinance, which
administration and nforcement would otherwl e be the r span­
slblllty of the Clt¥ of Hlghlandod Park
2. Olsctwge Urnlts At all times, the Clt¥ of Highland Park
hall through local ordlnanc enact and keep current dlsoharge
limitations no les stringent·than those of the DWSD. DWSD
haJl provide the Clt¥ Highland Park with Detroit's current was­
tewater ordinances or a model of the adopted current w -
tewater ordinances and dl oharge limitations and any
amendments thereto as they become effective.
31 OWSO Ccxnrnltmerrts. The Detroit Water and Sewerage

Inspection by the duly authorized representatives of the �
Highland Pack provided such representatives shall at all tim
maintain the confidentiality of &rrf data reviewed. Publlo Inspec­
tion shall be available, except as otherwise protected by
proprietary laws, rules and regulations.
B . .Pmml!a. Prepare, I sue, administer and revoke an In­
dustrial wast dlsoharge permit consistent with DWSD Enforce­
ment Response Plan (ERP), 40 C.F.R. Part 403 and National
and l..ocaI Pretreatment Standards and Requirements for each
'u r requiring a permit pursuant to the C't¥ of Highland Park
ordinance requirements.
C. Wastewater Contdbl rtloos, Deny or condition new or
Increased oontributlons of pollutants or changes In the natufle of
pollutants to the waste oolleotJon system by Industrial Users. The
term 'Industrial User" shall mean th9Se users defined In Section
______ of the city of Highland Park Ordinance No.

be amended from time to time and as defined In 40 C.F.R. Part
403.
D. In3PftC1iomr. and Syrvellloooo Carry out all Inspection,
surveillanoe and monitoring procedures necessary to determine,
Independent of Information supplied by Industrial Us«o, oom­
pllance or nonoompllance with applloable Nation. and Local
Pretreatment Standards and Requirements and other more
restrictive stan�ds and requirements as may be Imposed by
the BOARD or the Clt¥ of Highland Pack.
E. Qi:sctwge I JrnltatiQ03. From time to time, establish dis­
charge limitations, numerical and otherwise, as required for the
proper operation of the system and compllanQe with Its NPDES
permit, approved programs, and federal, state and IooaJ laws,
rul and regulations. .
F. POIW Spill Protection. Require Industrial Users to Install
rvnent facilities to protect the POlW from accidental spills
orltlcal or hazardous materials In accordance with ordinance
requirements. •
G. AdmlristratlyeActlon. Subject to the terms and conditions
of the ERP adopted by the DWSD pursuant to 40 C.F. R. Part
403 and Incorporated herein by reference, utilize admlnlstratlw
dons against the Industrial Users to bring about correctlw
ons In the event of a finding of nonoompllance with looaJ, ate
or federal laws, rules and regulations as pertains to the user's
discharge. DWSD shall notify the City of Highland Park, In
writing, addressed to the City or Village Manager or Township
Supervtsor of the of c't¥ gf Highlood Pack of all formal administra­
tive actions, Inoludlng notices of all hearings. The City gf High­
land Park Is Invited to have a representative appear and be heard
at the hearings. The DWSD shall make the final deolslon on the
oontents of &rrf resulting conciliation agreement or order I ued.
In the event th city of Highland Pork does not gree with the
oontents of &rrf oonclllation agreement or order I lied by DWSD
In the 06u� of any administrative action. The City, Village or
Township shall notify DWSD of the �Is of Its dlsagreem nt,
and the parties hereto shall enter Into d scussions for the pur­
poses of resolving MY differences. DWSD will Inform the Clt¥.of
Hlghlood Park of Its finding of any nonoompllance.
H. I agel Action. In the event the DWSD determine that the
dlscharger's nonoompllance has reached a point where legal
. ctJon Is required or where legal aotion Is expressly provided for
by the DWSD's ERP, oonduct that legal action In Its own name
to enforce the IooaI ordinance. Upon Instituting such leg aotion,
the DWSD shall provide a copy of the Complaint to the Cl1¥.d
H�bleod Park. The Clt¥ of Highland Park may Initiate aotton that
is not In oonJlKlction with the DWSD. Upon Instituting such legal
don, the CIt¥ of Hlgblaod Park shall provide a copy of the
Complaint to DWSD. Both partJ shall cooperate In providing
ant neoeeaary and requisite Istanoe to each other for the
Dng end prosecution of the legal action. Nothing In thl delega­
tion agreement shall be construed to preclude or prohibit either
pMy to this agreement from pertIolpating In legal action Inttlated
pu'8U8nt to this paragraph.
\ I. Removal Crodlt. To the extent authorized by law, In Its
oapaoIty as operator of a publlcly-owned treatm nt works,
. PWSD will, upon Implementation of a Removal Credit Program
'1Or Industrial Users covered by federal categorical andards, be
