mobile recycling unit also means the bins,
boxes or containers transported by trucks,
vans, or trailers, and used for the collection of

the facility operator and the hours of operation,
and display a notice stating that no material
shall be left outside the reoycllng enclosure or
containers. ,
(m) Signs may be provided In compliance
with the City's Ign regulations.
(n) The faoility shall not Impair the
landscaping required by local ordinance for
any concurrent use, by this article or by any
permit Issued pursuant this zoning ordinance
or any other ordinance of the City.
(0) No additional perking spaces will be
required for customers of a small collection
facility located at the established parking lot of
a host use. One spaoe will be provided for any
attendant.
(P) Mobile recyollng units shall have an
area clearly marked to prohibit other vehicular
parking during hours when the mobile unit Is
scheduled to be present.
(q) Occupation of parking spaces by the
facllltv and by the attendant may not reduce
available parking spaces below the minimum
number required for the primary host use un­
less all of the following conditions exist.
. (i) The parking study shows that existing
parking capacity Is not already fully utilized
during the time the recycling facility will be on
the site.
(II) The permit will be reconsidered at
the end of 12 months.
(III)A maximum five (5) spaces reduction
will be allowed when not-In conflict with parking
needs of the host use.
(r) If the permit expires without renewal,
the collection facility shall be removed from the
site on the day following permit expiration.
(2) A large collection facility Is one that Is
larger than 100 square feet, or Is on a separate
property not appurtenant to a host use, and
which may have a permanent building. A large
collection facility Is permitted In commercial
and all Industrlallyzones with a special-land
use permit, provided the facility meets the fol­
lowing standards:
(a) Th faoility does not abut aproperty
zoned or planned for residential use.
(b) . The faoility will be screened from the
publlo right-of-way by operating In an enclosed
building or:
(I) Within an area enclosed by an opaque
fence at least six (6) feet In height with
landsoaplng;
(II) Is t least 150 feet from property
zoned or planned for re Identlal use; and
(III) Meets all applloable noise standards

(D) Criteria and Standards. Those recycling
facilities permitted with a secondhand and Junk
dealers license shall meet all of the applicable
criteria and standards listed. Those recycling
facilities permitted with a special rand use per­
mit shall meet the applicable criteria and
standards, p,rovlded that the Zoning Ad­
ministrator, Planning Commission; or City
Commission, as the oase may be, may relax
such standards or Impose stricter standards as
an exercise of discretion upon a finding that
such modlfloatlons are reasonable and neees­
�ary In order to Implement the general Intent of
this Seotlon and the purposes of this Article
XIV. The criteria and standards for reoyollng
facilities are as follows:
(1) Small'collectlon facilities may be sited
In oommerclal, busfneee, and Industrial zones
with a special use permit provided they comply
with the all following condltlona.,
(a) Shall be established In conjunction
with an existing commercial use or community
servloe facility which Is In compliance with the
zoning, building and fire code of the City of
Benton Harbor.
(b) They shall be no larger than 100
square feet and occupy no more than two (2)
parking spaoes not Inoludlng space that will be
perlodloally needed for removal of materials or
-exohange of oontalners.
(c) They shall be set baok at least ten
(10) feet from any street line and shall not
obstruot pedestrian or vehloular olroulatlon.
(d) They shall aocept only glass, metal,
plastic oontalners, papers and 'reusable Items.

sion of the.oounty public health official.
(e) They shall use no power-driven
processing equipment.
(f) They shall use containers that are
oonstructed and maintained with durable
waterproof and rustproof material, covered
when the site Is not attended, secured from
unauthorized entry or removal of material, and
shall be of a oapaclty sufficient to ao­
cornmodate materials colleoted' and oollectlon
chedule.
(g) They shall store all recyclable material
In oontalners or In the mobile unit vehlole, and
shall not leave materials outside of oontalners
when an attendant Is not present.
(h) They shall be maintained free of litter
and any other undesirable materials, and
mobile faollltles, from which the truok or,oon­
talners are removed at the end of eaoh colleo­
tlon day, shall be swept at the end of eaoh
colleotlon day.
(I) They shall not exoeed noise level of 60
dBA as measured at the property line of
residentially zoned or oocupled property,

by a fence or wall not less than six (6) nor more
than eight (8) feet In height and landscap don

(C) Power-driven processing shall be per­
mitted, provided all noise level requirements
are met. Ught processing facilities are limited
to baling, brlcquettln�, crushing, compacting,
grinding, shredding and sorting of source­
separated recyclable materials and repairing
of reusable,materlals.
(d) A IIgkt processing facility shall be no
larger than 45,000 square feet and shall have
no more than an average of two (2) outbound
semi-truck shipments of material per day on
residential streets, and may not shred, com­
pact or bale ferrou metals other than food and
beverage containers.
(e) A processing facility may accept used
motor 011 for recycling from the generator in
accordance with applloable local, county and
state and federal law , rules and regulations.
(f) Setbacks and landscaping require­
ments shall be those provided for the zoning
district In which the facility Is located.
(g) All exterior storage of recyclable
material shall be In sturdy containers or
enclosures which are covered, secured, and
maintained In good condition. Storage con­
tainers for flammable material shall be con­
structed of non-flammable material. 011
