In August 1989 the city settled
the 6.2 million lawsuit for
$325,000 and agreed to
develop a new promotional
sy tern.
Officers were required to
take the written portion of the
promotional exam on a pas -
fail baSIS rather than for
numerical score .
Members of the Fraternal
Order of Police Lodge 0.97,
in exchange for accepting the
new ystem, are now per
mitted to retire with full
benefit at age 50 rather than
55.
The 23-page lawsuit char-
es the city's past conduct in .
..promotion gave the plaintiff
officers "a legitimate and
reasonable expectation of
being promoted to the rank of
ergeant."
Some officers allegedly
ere as ured by the city that
they would be promoted.
The plaintiff state they
asked the FOP to file a
grievance challenging the new
procedure but the union
ref ed,
"Why should these people
have to take the new test in the
firs: place?" questioned plain
