Senate confirmed the nomina­
tion of Sidney Fitzwater of
Texa to a lifetime appointment
as a federal judge de pite
charges by Democrats that he
tried to scare offBlac voter in
an 1982 election.
The coat ored 52-42 to
confirm the 32-year-old tate
jurist nominated by Pre ident
Reagan to the u.S. District
Court for the northern district
of Texas. He will be the
youngest sitting federal judge.
Approval of Fitzwater came
after th Senate voted 64-33,
four more than needed, to in­
voke cloture and limit debate on
his nomin tion.
In a ometime harp
hourlong debate before cloture,
opponent renewed charges
Fitzwater tried to intimidate
voters with warning signs in
some Black precincts in Dallas.
Supporters countered it was
"ludicrous" to turn do n a
brilliant young judge with a pro­
mi ing future.
Sen. Paul Simon, D-IlL, step­
ping into the liberal-conserva­
tive exchange, conceded Fitz­
water made "one mistake"
when posted the signs in Dallas
precincts before Election Day
1982 but that he should not be
b ned from the bench.
He asked, "Is there any in­
dication of a pattern of racism in
this judge?"
"I came to the conclusion
there is no such patt rn," Simon
said. "Should he be denied
becau e ofthis one mi take?"
But Senate Democrats, led I
by Sen. Edward Kennedy of
Massachu etts, Howard Met­
zenbaum of Ohio, Joseph Biden
of Delaware and Paul Sarbanes
of Maryland, disagreed.
