was "disappointed, albeit not sur-
prised" by the ruling.
He said the case might be ripe for
the Supreme Court to take up as a
major vouchers case because of a
patchwork of conflicting lower-court
decisions — including a decision by
the Ohio Supreme Court upholding
the Cleveland program in a separate
legal action.
Marc Stern, legal director for the
American Jewish Congress, a group
that opposes vouchers, said that
although the justices do not automati-
cally have to take the case, pressure is
growing for them to do so.
"Often the court likes to let issues
percolate in the lower courts, to make
sure all aspects are exposed and debat-
ed," he said. "But there's a point where
we see diminishing returns in that
process. That probably has happened
with vouchers, so it's likely they will
review the Cleveland case."
Voucher opponents had hoped for a
case involving a program open to all
students in a state; the Cleveland pro-
gram is open only to students in a fail-
ing school district, a fact that could
muddle some of the church-state issues.

The presidential succession may still
be a mess and Congress may be poised
for the biggest session of gridlock ever.
But some events in the capital are pro-
ceeding without a hitch — like
Chanukah.
On Nov. 21, a still-unspecified
group of dignitaries will help light the
nation's official menorah von the Ellipse,
just yards from the White House.
Rabbi Levi Shemtov, Washington
director for American Friends of
Lubavitch, promised another Chanukah
spectacular, although he admitted that
lining up official guests was more diffi-
cult than usual because of the uncer-
tainty over the presidential election.
"People are distracted," he said.
Once again, the event will be
chaired by Deputy Treasury Secretary
Stuart Eizenstat, the man most
responsible for getting permission to
erect the first official menorah during
the Carter administration.
Shemtov is also presiding over a
Chanukah parry at the International
Monetary Fund and a gathering for
congressional staffers. This year's
Capitol Hill party will be hosted by 19
Jewish House and Senate members —
a list topped by Sen. Joe Lieberman
(D-Conn.), the Democratic vice presi-
dential candidate. ❑
