his annual State of the Judiciary report
last December, Rehnquist criticized the
Senate for its sluggish pace in confirm-
ing federal judges.
"The Senate is surely under no
obligation to confirm any particular
nominee. But after the necessary time
for inquiry, it should vote him up or
down," he wrote.
White, a Detroit resident whose
Jewish involvement includes member-
ship on the Jewish Fedeiation of
Metropolitan Detroit's Board of
Governors and the United Jewish
Appeal's Young Leadership Cabinet,
said she is "patiently waiting to see
what happens."
Her understanding, she said, is that
Sen. Abraham had been expecting
Clinton to consult him before nomi-
nating her, and Clinton apparently
failed to do so.
"[Abraham] doesn't have opposition
on a personal basis, but there are pro-
cedural problems," White said. "My
approach is I've heard Senator
Abraham is a reasonable person who
generally gets along with people and
approaches things in a thoughtful
manner, and I'm going to assume this
will be resolved. But I won't be held
hostage for a disagreement I'm not
really a part of."
White said she will withdraw from
the Michigan Court of Appeals race if
the Senate confirms her nomination
before November, but "things would
have to move at a fairly rapid pace"
for that to happen.
Despite the extended vacancy on the
bench, the U.S. Court of Appeals for
the Sixth Circuit is functioning smooth-
ly, said court clerk Leonard Green.
"When there's a vacancy, the court
supplements by using services of semi-
retired judges and federal district court
judges," he said. "If Judge White had
been confirmed and in place, then
there just would have been less need
for visiting judges."
Green said there was no backlog of
cases directly attributable to the vacan-
cy, speculating that the waiting period
of approximately a year between when
a case is filed and when it is heard is
due more to an increase in filings than
to shortages on the bench.
Other candidates for the two open-
ings on the Michigan Court of
Appeals in this November's election
are White's fellow incumbent, Judge
Myron Wahls, and challengers Helen
Brown and Daniel P. Ryan. ❑
