Giles added that Chrysler is acting
within its legal rights. Chrysler won a
similar case in 1992 after it laid off a
Seventh Day Adventist for absences
due to religious obligations.
While Title VII of the Civil Rights
Act requires employers to "reasonably
accommodate" the religious beliefs or
practices of their employees unless
\ --going so would cause the employer to
suffer undue hardship, courts current-
ly have considerable leeway in defining
undue hardship and reasonable
accommodations.
Regardless of the final outcome, the
ongoing struggle is taking an emotion-
al toll on Fishler, who is one discipli-
nary step away from a three-day sus-
pension without pay. He describes the
,vorkplace as a stressful one in which
anti-Semitic incidents have occurred,
and he feels uncomfortable discussing
the scheduling conflict with his co-
workers.
The fact that Fishler is ba'al teshuva
(newly observant) and once was will-
ing to work on Shabbat has made it
more difficult for him to argue his
case with management, he said.
"They thought I was crazy not
wanting to work on Saturdays, especial-
ly since I'd done it in the past," he said.
But despite the pressure, Fishler is
holding fast to his observance now,
regardless of the consequences.
"I know what I'm doing is right, so
win or lose I can't do anything other
than what I'm doing," he said. "It will
be what Hashem (God) wants."
His rabbi for 22 years, Edward
Garsek, vouches for him.
"Barry's always been very conscien-
tious about his Judaism and over the
years I've seen a slow evolution take
place in terms of his level of obser-
vance," he said. "He's very sincere in
what he's doing." 0
