with a menorah. It's still a religious
symbol, even with two religions."
Lobenthal says that displays like
Walled Lake's, even with the religious
symbols, do not violate the constitu-
tional separation of church and state.
The ACLU has received several
calls from people about holiday dis-
plays, but hasn't had an opportunity
to check them yet. Lobenthal antici-
pates an incremental increase continu-
ing on into the holiday season. He
declined to comment further about
the complaints.
"Some of what people told us about
clearly sound like violations," he said.
"Other times, people may be disturbed
by what's there, but it's within the law."
One instance that was not within
the law was in Birmingham. A creche
was located on city property, but was
given away to a local church.
"We have nothing religious, not
even a Santa house," said
Birmingham's Principal Shopping
District Director Gail Gotthelf.
"We've been encouraging merchants
to put up lit displays of snowflakes or
ice skaters or sleds for the season feel,
but nothing religious."
That is part of the PSD "Holiday
Lights Program," in which the city
will put up, take down, and store the
displays for the first two years. After
that, the merchants must cover the
storage costs.
The City of Clawson went to court
in 1990 against the ACLU and won
the right to display its holiday decora-
tions which include a creche, with
Santa Claus in his sleigh and reindeer.
It still stands. El
