he trial of a man who
allegedly attacked Dr.
Mark Diem in June 1996
has been adjourned again,
this time until January of next year.
Marc Vincent Yaden, 41, is set to
be tried Jan. 7 for assault with intent
to commit murder, a charge that car-
ries a maximum penalty of life in
prison. He is free on $5,000 bond.
Yaden, according to police, beat
and kicked Diem outside one of
Diem's former clinics in Warren on
June 27, 1996, after the doctor
refused to refill a prescription for the
painkiller Vicodin. Diem, 52, was left
with skull fractures and broken ribs.
He has since retired from medicine.
Trial delays
inflict more pain.
Yaden was examined in December
last year and found to be mentally
competent to stand trial.
The trial, which is scheduled
before Macomb County Circuit
Judge Patrick Donofrio, has been
adjourned four times. Yaden's former
attorney, Walter Meyers, withdrew
from the case. His new attorney,
Timothy Barkovic, is in trial in a dif-
ferent court. Assistant Prosecutor Eric
Kaiser will try the case.
