one of the results."
The new legislation also could
prohibit states from modifying ex-
isting consumer protection laws.
A similar measure was beaten
back last year this year's version,
Mr. Cohen said, "is worse because
it doesn't contain any safety
hatches that would have protect-
ed some state kosher food laws."
In the Senate, a uniformity
provision deals only with drugs
— but there are rumors that an
amendment may be in the offing
extending the measure to food
products.
The FDA bill poses some
strategic problems for Jewish
groups.
Carving out a specific exemp-
tion for kosher foods could raise
tricky constitutional issues, Mr.
Cohen said. Instead, the group is
recommending that the bill be
modified to confine itself strict-
ly to health and safety-related
food issues. Consumer protection
laws regulating the kosher foods
industry generally deal with is-
sues such as labeling.
Some 24 states, including
Arkansas, now have laws pro-
tecting kosher consumers, Mr.
Cohen said. The tremendous
growth of the kosher foods in-
dustry has led Agudah and oth-
er Orthodox groups to push for
additional state protections, an
effort that would be jeopardized
by the pending legislation.
