and to condemn those who
do not observe them.
The question, therefore, is not S'
about the rabbinate; it is about
the state. Shall the state decide
that the standards promulgated
by one group of rabbis are supe-
rior to those promulgated by an-
other?
That would be very messy, in-
deed. And that is the point. We
are living inside exactly that
mess.
Only a handful of people favor
cleaning up the mess by a radical
separation of rabbinate and state.
The American system is not, even
at the theoretical level and sure-
ly not at the practical level, a de-
sirable or a plausible option.
Given Israel's Law of Return,
under which virtually any Jew
who comes to Israel is granted au-
tomatic citizenship, there must
be some definition ofjust what is
meant by "Jew."
It will not do to hold that any-
one who claims to be a Jew is in
fact a Jew; these days, with Is-
rael's relative affluence and such
grinding poverty in so many parts
of the world, millions of people
might claim to be Jews and make
their way to the Jewish state. So
some definition is required, and
it is the state that must provide
it.
No easy matter. But the fact
that it is not easy ought not lead
the state to abdicate its responsi-
bility, turning it over to a rab-
binate that thereby becomes an
agency of the state.
There are inherent existential
contradictions here, and they are
both confusing and painful. Sc --
long as Israel remains the Jew-
ish state and wants as well to be
a liberal democracy, there is no
ready solution to those contra-
dictions.
But the status quo, overtly dis-
criminatory, is no solution at all.
Given Israel's centrality in Jew-
ish life, what happens to Judaism
there happens not only there, but
everywhere there are Jews. The
state of the Jews is not the state
ofJudaism; Judaism has no state,
and in that it is blessed.
Accordingly, the state and sta-
tus ofJudaism do not "belong' to
the State of Israel. In the nature
of things, the Israeli political ech-
elon will act as if it does; Israeli
Minister of Infrastructure Ariel
Sharon will have more to say
about what Judaism means than,
say, Rabbi Ismar Schorsch, than
cellor of the Jewish Theological
Seminary of America.
That perversity must be
stopped; we here are both re-
quired and entitled to oppose it,
to insist as forcefully as we can
that Judaism must not be treat-
ed as a bargaining chip in gov-
ernment, that all Judaism's
stakeholders have standing in the
search for an arrangement thL -
will replace the current system
flawed beyond repair. ❑
