A Small Mistake?

Religion enters the arena of judicial politics.

imberly Small has had
second thoughts lately.
Not about her campaign
for 48th District Court
judge, but about one of her recent
campaign strategies.
Although she feels elements
of her campaign literature —
which have raised a few eye-
brows — were taken
out of context, it
would have been eas-
ier if a certain mail-
ing never went out.
The piece in ques-
tion reads: "In the
Book of Judges, we
find many examples
demonstrating the best qualities
of Jewish leadership. In the race
for 48th District Judge, we find
yet another — Kimberly Small."
The 48th District Court cov-
ers West Bloomfield, Bloomfield
Hills, Bloomfield Township,
Birmingham, Sylvan Lake, Or-
chard Lake and Keego Harbor.
The campaign piece features
the names of several prominent
members of the Jewish commu-
nity, including Seymour Brode,
David Hermelin and Robert Sos-
nick. In small print the names of
nearly 250 Jews are also listed.
Ms. Small is Jewish.
Her critics claim she is play-
ing to the Jewish community for
support. She maintains the pas-
sage in question was taken out
of context and the literature is
no different than the advertise-
ments some candidates take out
in The Jewish News.
She thinks the language in
her piece was misinterpreted and

maintains it was not something
that says, "Vote for me because
I'm Jewish." Ms. Small said she
didn't write the passage; a grou
of supporters put it together. But
she assumes full responsibility.
"If anyone really looks at [the]
language, [he or she] will see the
reference is to the quality of lead-
ers in the Book of
Judges," she said.
"What it says is
[that] I have the
quality of those Jev
ish leaders found in
the Bible."
Bruce Leitman, a
private-practice at-
torney in Bloomfield Hills who
acts as a court-appointed attor-
ney for the 48th District Court
and is active on Judge Thomas
Brookover's re-election cam-
paign, called Ms. Small's tactics
distasteful.
"I believe I'd find it equally o
fensive if I didn't know Judge
Brookover," he said. "All the lit-
erature said was, 'Vote for me be-
cause I'm a Jew.' There was no
other reason. She didn't suggest
any other qualifications or indi-
cate that Judge Brookover is a
bad judge."
Ms. Small said this particular
piece of campaign literature
not list her qualifications because
three previous campaign pieces
did.
Judge Brookover feels it is dif-
ficult to respond to Ms. Small's
literature, which was mailed to
Jewish households just before
the Aug. 6 primary.
"Judges," he said, "have to
