He said he can still vividly re-
call the early days of his practice
when officers acted like Gestapo
agents, beating up black residents
"irrespective of whether they were
guilty or not."
"Police officers haven't changed
since the dawn of history and they
still are brutal," he wrote scorch-
ingly to the Supreme Court in the
McMahan case. Citing the con-
victions of two Detroit officers in
the beating death of Malice Green,
he wrote, "Counsel believes that
all prosecutors and criminal
laiNyers should take a refresher
course on what is still going on
around them in criminal justice."
Norman Lippitt, an attorney in
Birmingham, said-Mr. Kraizman
and other defense lawyers of his
era never forgot the injustices of
their youth.
"They had a code where they
would fight for the downtrodden
and the accused," Mr. Lippitt said.
"These guys were like Damon
Runyan characters, and they are
gone forever."
Mr. Kraizman said he accepts
as fact that the general public does
not share his enthusiasm for the
rights of the accused.
"Because of the high crime rate
the public is swinging to the con-
servative side, where they are
thinking every man who's charged
with a crime should go to jail and
that lawyers who defend them are
scoundrels."
But he remains unfazed.
"My job as a lawyer is to see jus-
tice is done," he said. "If the pros-
ecutor cannot prove a man guilty,
who am I to suddenly become a
judge and say he's guilty?
"I have no doubt in my mind;
that is not my job."
He said he also draws strength
from his religion. Sitting at a desk
that seemed enormous in front of
him, he tapped a finger lightly and
said, "I am a shul man."
Mr. Kraizman, of West Bloom-
field, is a past president of Con-
gregation B'nai David. He has
even represented the shul in court,
winning a favorable court settle-
ment in a land dispute (Deuteron-
omy — chapter 19, verse 14,
"Thou shalt not remove the land-
mark of thy neighbor").
Indeed, his religious training
informs many of the arguments
he makes in court, the McMahan
case being but the latest example.
It is only logical, he said. After all,
English common law judges often
drew inspiration from biblical de-
crees.
"Where do you think the com-
mon law came from?" he asks. "It
came from Torah."
Which is why Mr. Kraizman
was speaking in Hebrew to the
Michigan justices one day last No-
vember:
