ADR, according to Mr. Golden, is the "new way." `There's something about hav- ing the ability to control the situation and outcome that is palatable to both employer and employee," he said. The degree that ADR will be part of the resolution process in employment cases depends on a highly anticipated ruling before the Michigan Supreme Court. The justices will determine whether an employer can unilat- erally impose arbitration. Regardless of the outcome of that case, said Mr. Golden, ADR has already had a substantial in- fluence. "Lawyers must fine-tune their communications skills and be pre- pared to go through mediation," he said. Last December, attorneys Bar- bara A. Johannessen and Ms. Klein established the for-profit Mediation Specialists Inc. in Southfield. Ms. Klein, who will remain in her position at Oakland Mediation Center, has extended her mediation expertise to the area of divorce. Clients at Mediation Special- ists Inc. are referred by marriage counselors, social workers and at- torneys, said Ms. Klein. In dis- putes between traditional Jewish couples, she noted, the terms of a get can be negotiated. "We provide the parties with questions to get them thinking about compromise," said Ms. Jo- hannessen, an attorney who spe- cializes in business law. "They have to negotiate and think about what they want. We've seen peo- ple take responsibility when they have a role in the mediation process." In divorce cases, Ms. Johan- nessen noted, most couples want to preserve their privacy and maintain their integrity. "ADR is a way we can educate our clients," she said. "It's also a way to improve the image of our profession." ❑ . $20,879.00 Prestige Package, Loaded! $15,149.00 V-6, Cruise, 15" Wheels 55/45 Seats ELECTROLYSIS Specializing in Body & Facial Hair Removal for Men & Women Call for Free Consultation Victoria Palace RE.
