In an opening statement, the lawyer for Herzl Rad, 31, said his client admitted that he was in Iran, but said he was innocent of any ac- cusations related to spying. Mr. Rad, a dothing merchant in Jerusalem, has been in detention since his arrest this summer. He has been charged with spying for an enemy country, endangering national security and having con- tact with foreign agents. According to the charge sheet: Mr. Rad went to Turkey earlier this year, where he initiated con- tact with an Iranian intelligence officer. A month later, he was flown to Iran under an assumed name and was interviewed. After accepting him, the Iranians instructed Mr. Rad to gather information in the United States and Israel. In ex- change for his services, he would be paid $10,000. The charge sheet also said Mr. Rad promised to enter Israeli army bases and collect information. Mr. Rad's lawyer, Amir Zion, re- iterated his client's version of the story, saying that he was kid- napped from Turkey and tortured by the Iranians. The petitioners from Temple Mount Faithful recently argued that their right to enter the com- plex was protected under the right to freedom of worship. The Temple Mount is the loca- tion of the First and Second tem- ples, the holiest Jewish site. It also is home to Islam's third holiest site, the Al-Aksa Mosque, where the Koran says the prophet Mo- hammed ascended to heaven on a white steed. The Temple Mount Faithful movement seeks to restore the temple. In July, the court allowed the group to enter the Temple Mount complex on Tisha B'Av, the Ninth of Av, which commemorates the destruction of the First and Sec- ond temples. But police closed down the site after Muslims tried to confront Jews at the site.
