Agudath Israel of America has
filed a "friend of the court" brief
in a case involving a Seventh
Day Adventist who resigned
from the Tampa, Fla. police de-
partment because officials there
would not accommodate his Sab-
bath observance requirements.
A Court of Appeals decision
ruled that the police department
waswithin its rights to refuse a
religious accommodation because
of the "undue hardship" it would
cause. That legal standard,
which says that religious ac-
commodations can be abridged
if they force an employer to ab-
sorb anything more than the
bare minimum costs, clearly
demonstrates the weakness of
current federal laws for the pro-
tection of religious minorities, ac-
cording to Agudah.
The Orthodox group wants the
high court to revamp that stan-
dard to
encompass anything that
would result in "significant diffi-
culty or expense."
"These changes would go far
in putting religious discrimina-
tion on a par with other forms of
discrimination," said Abba Co-
hen, Washington representative
for Agudah. "And they would
help the religious accommoda-
tion law that currently exists to
live up to its original promise."
At the same time, the Ortho-
dox group continues to work with
Rep. Jerrold Nadler, D-N.Y., who
may soon introduce his long-
awaited religious accommoda-
tions bill.
A decision in the Florida case
is expected by the end of the
month.
