A: The Torah and Talmud dis- cuss the subject at length and, in rare cases and with many stip- ulations, support its usage. First, it is applicable only for murder, blasphemy, desecrating the Shabbat, kidnapping, witch- craft, dishonoring one's parents and sexual crimes like incest. There must be two witnesses to testify to the crime. The ac- cused must have been told at least twice both that his actions were wrong and that they could result in death. A court of judges must try the case. The Torah mentions three kinds of capital punishment — stoning, burning and hanging, while the Talmud cites strangu- lation. Stoning was the most-often prescribed method of death, but not in the way most people imag- ine. The Talmud specified that the condemned should be pushed to his death in a "stoning place" — neither too high (so the body wouldn't be mutilated) nor too low (so that death would be in- stantaneous). Burning is to be used only in the case of adultery by a priest's daughter and in certain instances of incest. Because Jewish law does not permit descration of the body, though, rabbis devised a system whereby a burning wick was tossed into the guilty party's mouth — amounting, essentially, to strangulation. Yet anyone looking for reports of the death penality used in Jew- ish communities at any time in history would be hard-pressed. There is not a single incident of a Jew being burned or strangled or killed with a sword, and many speculate that 99 percent of the discussions about ways to im- plement the death penality nev- er were meant to be anything more than that: discussion. In fact, rabbis from throughout his- tory have argued for abolition of capital punishment. Interestingly, the State of Israel does have the death pen- alty — but only in cases of trea- son during war and of genocide. The prescribed method of execu- tion: soldiers are to be shot and all others hanged. The only man executed in Is- rael was Nazi Adolf Eichmann, who was hanged to death on May 31, 1962.
