He also said the decision was a major blow to Christian right groups. "Their whole strategy of get- ting more government support for religious institutions received a big setback in this case," Rabbi Saperstein said. "That's one of the most overlooked aspects of the Kiryas Joel decision." The decision was also good news for Jewish activists who hadworried that the Supreme Court was edging towards scrap- ping the"Lemon test" — a legal precedent that has become the Court's benchmark for deciding when a government action cross- es thechurch-state line. In their decision, the justices sidestepped the Lemon test,ac- cording to Elliot Mincberg, legal director for People for theAmer- ican Way. "The Court showed that it doesn't have to use Lemon in every case," he said. "I have no problem with the idea of using different tests for different cas- es." That aspect of the Kiryas Joel decision, according to severalan- alysts, will send legal scholars scrambling to find alternativele- gal benchmarks. But even supporters of the de- cision worried about the chil- drenaffected by the case. "This isn't just a case of con- stitutional principle," said Marc- Stern, legal director for the American Jewish Congress, which argued against the special school district. "Now the obliga- tion is to provide these children with an education. That doesn't disappear because of the Supreme Court decision." ❑ Israel TV Seen In Basel ' Geneva (JTA) — A cable televi- sion station in Basel will soon be- gin relaying transmissions of Israel Television to some 1,000 Jewish families living in the northwestern Swiss city. The decision came after some three years of requests for the transmissions from Hebrew- speaking families living in Basel. Among the arguments that fi- nally convinced Balcab, the Basel cable station, to proceed was that the city would gain additional publicity when the centenary of the first Zionist Congress will be marked there in 1997.
