record that would disqualify him,
from our perspective," the official

Mr. Breyer's nomination came
after the president concluded that
his other top choices — Interior
Secretary Bruce Babbitt and
Judge Richard S. Arnold —
would face stiffer resistance in
the Senate at a time when the ad-
ministration has its hands full
with its complex domestic agen-
da. Mr. Breyer enjoys strong bi-
partisan support, and the
energetic backing of Sen. Edward
Kennedy, D-Mass., who worked
tirelessly for the nomination.
One of the few voices of dissent
came from retiring Sen. Howard
Metzenbaum, D-Ohio, who ex-
pressed concern about indications
that Mr. Breyer favors corporate
interests in legal wrangles over
government regulation.
As a judge, Mr. Breyer has
heard only three cases involving
the sticky area of church-state
separation.
"He seems to be fairly separa-
tionist in his approach," said J.
Brent Walker, general counsel
for the Baptist Joint Committee
— the group that has taken the
lead in a religious liberties coali-
tion that includes a number of
major Jewish organizations.
"It appears to be a solid, work-
manlike record. He is meticulous
in his approach, and it looks like
a fair appointment from achurch-
