Will he be retried?

Set A Retrial

Jerusalem (JTA) — r_ieventy-
five percent of Israeli adults
believe John Demjanjuk
should be tried again here
for Nazi war crimes, accor-
ding to a new Gallup poll
commissioned by the Los
Angeles-based Simon
Wiesenthal Center.
Mr. Demjanjuk was ac-
quitted July 29 by the
Supreme Court of being the
so-called "Ivan the Terri-
ble," a particularly bestial
gas chamber operator at the
Treblinka death camp.
But the court found
evidence that Mr. Demjan-
juk served as an SS guard at
the Sobibor death camp.
Efraim Zuroff, director of
the Wiesenthal Center's
Israel office, said the poll is
proof that the public is
outraged by the court's deci-
sion and seeks justice.
Holocaust survivors and
Jewish groups, including the
Wiesenthal Center, have fil-
ed petitions with the high
court to prevent Mr. Dem-
janjuk's deportation until he
can be tried for crimes com-
mitted at Sobibor.
The petitions follow a U.S.
appeals court ruling Aug. 3
that Mr. Demjanjuk must be
allowed to return to the
United States, from which
he was extradited to Israel
in 1986. The 6th U.S. Circuit
Court of Appeals in Cincin-
nati also ruled that Mr.
Demjanjuk could not be tried
in Israel on additional
charges.
The Justice Ministry here
maintains that ruling is not
binding on the State of
Israel. But it has not decided
yet whether to press further
charges. Israel's attorney
general is scheduled to an-
nounce a decision. E
