going back to our European ex-
perience. Governments that
have dealt with groups, not in-
dividuals, have always produced
bad results for Jews."
Jews, he suggested, thrive in
a meritocracy. When numbers
become the basis for winning
the rewards of society, such as
in job advancement or in politi-
cal representation, Jews tend to
lose out.
Mr. Stern's second argument
involves a more immediate kind
of self-interest. "Some interpre-
tations of the [Voting Rights]
Act, which emphasized creating
ethnic districts, have been dele-
terious to Jews," he said. " ,' 7e
have seen examples in New
York, Florida, Ohio and Texas
in recent years."
Jews fear that creating black
and Hispanic districts will al-
most inevitably erode Jewish
representation since such dis-
tricts are likely to be created in
urban areas where Jews — and
other minority groups — are
concentrated.
Another concern centers on
the idea that expansive inter-
pretations of the Voting Rights
Act inevitably pit racial, reli-
gious and ethnic groups against
each other in a desperate fight
for political representation. Crit-
ics point to Florida, where Jews
and Hispanics are on opposing
sides in a court case centering
on the validity of the state leg-
islature's redistricting plan.
"We've had districts redrawn
which look as though they were
created by... drunken cartogra-
phers...," said Arthur Teitle-
baum, regional director in
Florida of the Anti-Defamation
League. ADL has filed an ami-
cus brief in the Florida case,
which is pending.
Many Jewish activists agree
that Jews' resistance to compli-
cated voting rights remedies —
whether out of high-minded
principle or immediate political
self-interest — poses serious
community relations problems.
`What's involved here are two
moral principles in tension with
each other, said Rabbi David
Saperstein, director of the Reli-
gious Action Center of Reform
Judaism and a longtime civil
rights activist who took a lead-
ing role in trying to bridge the
gap between Lath Guinier and
Jewish groups.
The first principle, he said, "is
the basic equality of all people,
the one-person-one-vote idea.
The other is the idea that when
a group of people have been sys-
tematically discriminated
against, we have an obligation
to eradicate the impact of that
long history of persecution.
We're trying to find a way of bal-
ancing the two principles. But
it's still a new phenomenon. We
haven't found that balance
yet."
