The Federal Food, Drug and Cosmetic Act obligates all new drugs to be proved safe and effective by the FDA. Seven months ago Judge Friedman ruled that, because he failed to file with the FDA, Mr. Sopcak could not dis- tribute CanCell. "My ruling had nothing to do with whether the formula was effective or not," he said. "It had to do with the fact that he didn't comply with the law. "But it seems to me that if he really cared about these people (to whom he dis- tributes CanCell), he would file with the FDA. If he would at least try, maybe I could use some discretion..." Mr. Sopcak said he has no interest in filing with the FDA both for legal reasons (he claims the FDA has no juris- diction over his product be- cause he does not sell CanCell or make a profit from it) and because he describes the bu- reau as "the enforcement arm of the AMA (American Medical Association)." The AMA, he claims, makes a lot of money off those with can- cer, and CanCell "is a suc- cessful treatment for both cancer and AIDS." Mr. Sopcak believes Judge Friedman is "a decent human being. I have no vendetta against him." But, he claims, neither Judge Friedman nor the FDA is really familiar with the CanCell formula as it is today. With each "increase in the vi- brational frequency of the uni- verse" Mr. Sopcak must change the CanCell formula. He says two such increases have occurred, in May and November, since the judge placed the injunction. Mr. Sopcak is appealing the court order. The forerunner of CanCell was first created as Entelev by James Sheriden in 1936. (Mr. Sheriden agreed to an in- junction before the case came to court, leaving Mr. Sopcak the sole defendant.) In 1984, Mr. Sopcak began working with the formula. He pro- duces it at his home. CanCell gained national at- tention two years ago after a Wisconsin couple began using the water to treat their 10- year-old son, who had bone cancer. They were later Bernard Friedman charged with child abuse (CanCell includes specific di- rections that it not be used with "any other cancer or AIDS therapy. This includes chemotherapy, radiation, hor- mone therapy, AZT, DDI, acupUncture, Rife or other vi- brational therapies, radionic, ozone or other oxygen thera- pies, etc.") Mr. Sopcak says the treat- ment is successful about 80- 85 percent of the time. Meanwhile, the letters keep pouring into Judge Fried- man's office; it's always heav- iest after a TV program With each "increase in the vibrational frequency of the universe" Mr. Sopcak must change CanCell. featuring CanCell, such as was aired last week on "The Maury Povich Show." Mr. Sopcak encourages his backers to write President Bill Clinton, their congressmen and senators and local media — and, of course, Judge Friedman. Letters have come to the judge from as close as Lansing and as far as New York. He labels them "heart wrenching" and says he often sees his secretary crying as she reads them. But the judge has plenty of supporters as well. The American Cancer Society has come out in opposition to CanCell, and numerous physicians have praised Judge Friedman for issuing the injunction. In fact, one wrote, "Why don't you do more?" ❑
