U.S. Court Dismisses
ft-Nazi's Suit

Washington (JTA) — A fed-
eral court has dismissed a
suit filed by ex-Nazi scientist
Arthur Rudolph seeking to
invalidate a 9-year-old
agreement in which Rudolph
agreed to permanently leave
the United States in
exchange for avoiding
criminal prosecution for war
crimes.
A federal judge in San
Jose, Calif., dismissed the
suit filed by Mr. Rudolph, a
manager of a German V-2
missile production facility
during World War II, the
Department of Justice an-
nounced.
Mr. Rudolph, who sought
to clear his name by filing
the suit, argued that the
1983 agreement should be
rescinded because it was
made under duress and con-
tained elements of fraud.
Mr. Rudolph, who had
been employed by the U.S.
Army and later by NASA as
manager of the Saturn V
rocket program, was also re-
quired to renounce his U.S.
citizenship as part of the
deal. Mr. Rudolph had
become a naturalized citizen
after the war.

At the time of the 198
agreement, the Departmen
of Justice's Office of Specia
Investigations, a special urn
of the Criminal Division se
up to deal with Nazi wa
crimes, was preparin
charges against him.
U.S. District Judge Jame
Ware dismissed on Feb.
Mr. Rudolph's suit for lack o
jurisdiction, and cited a
length a Canadian court fin
ding that Mr. Rudolph "
production director, ad
mittedly called for, made us
of, and directed forced labo
by foreign prisoners in th
production of the V-2 rocke
at Mittelwerk in the year
1943-1945. The condition
under which the prisoner
worked were indescribabl
brutal."
Mr. Ware also cited the
Canadian court's findin
that "Rudolph's admitted
activities gave reasonable
grounds to believe that he
was -an active participant
and accomplice."
The Canadian Federal
Court of Appeal was affirm-
ing an order barring Mr.
Rudolph from entering that
country.

New Scandal Rocks
Labor Party Partner

Jerusalem (JTA) — Iri the
latest scandal to rock
Israel's ruling coalition,
newspapers have dug up a
recorded speech by the spiri-
tual mentor of the Orthodox
Sephardic Shas party in
which he attacked the Labor
party for being a group of
"evildoers."
In the speech, recorded
several years ago, Rabbi
Ovadia Yosef also personally
insults Labor Knesset mem-
ber Avraham Burg, calling
him a "calf."
Rabbi Yosef accuses Mr.
Burg of making "deals" with
the Reform movement, and
faults Mr. Burg's father —
the former leader of the Na-
tional Religious Party, Yosef
Burg — for not properly
observing Jewish law.
After the reports were
published this weekend, Mr.
Burg hit back, referring to
Rabbi Yosef as "the so-called
rabbi with a style better
suited to the marketplace
than to Torah scholarship."
The publicized remarks

were only the latest to cause
trouble between Shas and its
present coalition partners,
Labor and the left-wing
Meretz bloc.

Rabbi Yosef's freewheel-
ing rhetoric triggered a co-
alition flap last week when a
tape, also made some years
ago, was released by
unknown sources and simi-
larly distributed to the local
media.
In that tape, Ildbbi•Yosef is
heard to imply that when
secularist politician
Shulamit Aloni dies,
"everyone should
celebrate."

Ms. Aloni, now minister of
education and head of
Meretz, was at the time part
of the political opposition.
The source of these tapes is
unknown, but well-placed
observers in the Orthodox
world point to factions
within the United Torah
Judaism party, the
Ashkenazic Orthodox rival
to Shas.
