that the appeal was a "long
shot" from the start.
"Mr. Pollard has acknowl-
edged that he committed a
serious violation of the law,"
Mr. Olson continued.
"However wrong he was, the
act remains the he was try-
ing to save the people of
Israel from the missiles of
Iraq and Iran and Syria —
' and his sentence was more
severe than those that have
been imposed on persons
who spied for enemies of the
United States during times
of war.
"The goal of punishment
has been achieved and the
time for compassion and
fairness is now."
Mr. Olson urged all
i Pollard supporters to write
the White House urging Mr.
Bush to act immediately.
Mr. Pollard, who has
steadily gained support
within the American Jewish
community after first being
shunned as a pariah, based
his appeal on the grounds
that the government reneg-
ed on its part of the plea
bargain agreement under
which he pleaded guilty.
His appeal, which offi-
cially asked that the plea
bargain be set aside and that
Mr. Pollard be allowed to
stand trial again, said the
government had agreed to
not seek the maximum
sentence for him and not to
prosecute his former wife,
Anne. In the end, the
government did ask for the
maximum sentence and also
prosecuted his wife as an ac-
cessory.
Then-Secretary of Defense
Caspar W. Weinberger, who
many Pollard supporters
consider the real heavy in
the case, submitted a letter
to the sentencing judge that
called Mr. Pollard guilty of
> treason, a federal crime Mr.
Pollard was never charged
with. Mr. Weinberger's
''' letter is viewed by Pollard
supporters as proof of what
they term the government's
blatant violation of its plea
bargain agreements.
When the Pollard case was
heard at the federal Court of
Appeals level prior to going
on to the Supreme Court,
one member of the three-
judge panel termed Mr.
Pollard's life sentence a
"fundamental miscarriage
of justice requiring relief."
,,_-, The other two judges, who
are Jewish, said they could
find no clear error on the
part of the sentencing judge
that required a new trial.
The former Anne Pollard
now lives in Israel, where
Mr. Pollard is also expected
to settle if he is released.
