The court's order followed fact-finding hearing in ich government counsel dmitted that "mistakes ere made" when the ice Department failed to sclose evidence suggesting hat a man identified as Ivan archenko was in fact the el Nazi guard referred to y Jewish prisoners at the eblinka death camp as `Ivan the Terrible." In its three-page order, the ourt of Appeals for the 6th ircuit rejected the Justice partment contention that he court does not have the ower to review its decision. The "bedrock question" for he court, according to Chief ustice Gilbert Merritt, is ether failure by govern- _ ent attorneys to disclose xculpatory information ituted fraud. To make its determina- ion, the court has appointed omas Wiseman Jr., a fed- ral district judge in ashville, Tenn., as a spe- ial master and instructed m to prepare a report after uestioning four govern- ent lawyers who previous- y worked on the Demjanjuk se. The four are Allan Ryan r., a former director of the ustice Department's Office 1' Special Investigations, hich prosecuted the case; orman Moscovitz and eorge Parker, attorneys ho worked at OSI; and ohn Horrigan, a former ssistant U.S. attorney for e Northern District of hio. Patty Merkamp Stemler, hief of the appellate section f the Justice Department's riminal division, argued in last week's hearing that the osecution is not required o prove guilt or innocence ut only to show probable cause that the defendant committed the offense. She maintained that dur- ing extradition proceedings be department was not obligated to disclose certain documents — including ex- cerpts from statements of other prison guards it had obtained from Soviet au- thorities — because they did not contain references to "Ivan the Terrible," although they did mention a "Marchenko." She also said the federal court does not have jurisdic- tion to review its 1985 judg- ment, since the case is now in the hands of an Israeli court. Mr. Demjanjuk, a 72- year-old former Cleveland area autoworker, claims that he is innocent and that this is a case of mistaken identity. He is appealing the decision of an Israeli lower court which convicted him of war crimes and sentenced him to death as "Ivan the Terrible" in 1988. A response by Israel's High Court of Justice is re- ported to be imminent. Reunification Is Celebrated New York (JTA) — Plans have been unveiled for a yearlong celebration of the 25th anniversary of the reunification of Jerusalem in the United States and Israel. The project, designed to underscore Jerusalem's cen- trality to Israel and the Jew- ish people, is being organiz- ed by the Coordinating Committee for Jerusalem 25, under the aegis of the Conference of Presidents of Major American Jewish Organizations. A series of celebratory events will culminate in Jerusalem on Yom Yerushalayim next year, May 19, 1993. This past Yom Yerushalayim, on May 31, 1992, marked the 25th an- niversary of the reunifica- tion of Jerusalem during the 1967 Six-Day War. Next year, thousands of copies of a Covenant of Jerusalem, bearing the signatures of Jews all over the world, will be presented to the president of Israel. SHIVA BASKETS & TRAYS .. .
