But the alleged war riminal will not face pros- _ ecution for the mass murder — of 850 Jews from the Ukrai- ,nian village of Serniki. The ruling means that \ under Australia's strict rules of evidence, a case ex- --ists against Mr. Polyukhovich, 76, for the murder of six individuals. He will be tried for knowing participation in the Nazi campaign of genocide. The order, by Magistrate _Kelvyn Prescott, followed the failure of Mr. Polyukhovich's appeal against the charges and his efforts to get the war crimes law declared invalid. The 28-month-long court procedure that has been ongoing in Australia is akin , 2to a preliminary hearing in a I ) U.S. criminal case and is not the trial per se. — In Australia, before a trial s ordered, the court wants to see the prosection's evidence, including the witnesses, who are subject to I, cross-examination. In other words, it is something of a minitrial. Mr. Polyukhovich's actual trial is expected to begin later this year. But the open- ing may depend on the health of elderly witnesses ,) in the United States, Europe, Israel and ---- Australia, who must repeat in court the testimony they gave at the lengthy com- mittal hearings. - 2 Jewish leaders have not commented on the outcome of the hearing process, noting that the case is now in the hands of the courts. A second man charged with war crimes, Heinrich Wagner, 67, appeared brief- ly in court this week to hear charges that he murdered 20 people and participated in the deaths of 104 others in the Ukraine in 1942 and 1943. Denaturalization Actions Start Washington (JTA) — The Justice Department has begun denaturalization pro- ceedings against a Putnam County, N.Y., resident suspected of participating in the mass murder of Jews in Poland during World War II as a member of the Trawniki SS unit. A complaint against Jack "Jakob" Reimer, 73, was fil- ed in U.S. District Court in Manhattan by the Office of Special Investigations of the Department's criminal divi- sion and the U.S. Attorney's office for the Southern District of New York. It accuses him of willfully concealing his Nazi ac- tivities to gain entry into the United States in 1952 and obtain U.S. citizenship in 1959. The action was immedi- ately commended by the An- ti-Defamation League. "No one should be allowed to gain the blessing and benefits of American citizen- ship by means of covering up involvement in mass murder and crimes against human- ity," said Elliot Welles, di- rector of the ADL's Task Force on Nazi War Criminals. According to the com- plaint, Mr. Reimer admitted under oath to OSI attorneys last month that he served in the Trawniki SS unit, that its purpose was to assist the Nazi liquidation of Jews and that as a member, he par- ticipated in the destruction of the Jewish ghettos in Warsaw and Czestochowa in Poland. The OSI also alleges that Mr. Reimer admitted par- ticipating in a mass execu- tion of Jews in the vicinity of Trawniki, Poland, in 1941 or 1942 and that he personally fired his rifle into a group of 40 to 60 Jews forced into a mass grave. Mr. Reimer, Ukrainian by birth, received German citizenship in 1944. Before his retirement he was a res- taurant manager and distributor of snack foods.
