ing case for "mistaken iden-
tity."
The evidence suggests that
though the two men looked
very much alike in photos,
Mr. Marchenko was nine
years older than Mr. Dem-
janjuk, three-and-a-half in-
ches taller, had a facial scar,
was born in a different part
of the Ukraine and was mar-
ried with three children,
whereas Mr. Demjanjuk was
single at the time.
The most telling piece of
new evidence was an ac-
count given to the Soviet au-
thorities in 1951 by Nikolai
Shalayev, who was captured,
tried and executed by the
Red Army at the end of the
war.
Mr. Shalayev admitted
operating the Treblinka gas
chambers with Mr. Mar-
chenko and told his Soviet
captors that Mr. Marchenko
had been transferred by the
SS to the Italian port city of
Trieste in June 1943.
While the newly available
documents, which Mr.
Sheftel obtained from the
archives of the former Soviet
Union, tend to prove that
John Demjanjuk was not at
Treblinka, they strengthen
the impression that he serv-
ed as a guard at the Sobibor
death camp in Poland and at
the Flossenburg forced labor
camp in Bavaria.
Until now, the central
evidence produced by pros-
ecuting counsel Michael

Shaked was known as the
"Trawniki card," which,
showed that Mr. Demjanjuk
had undergone training by
the SS but which did not
specify where he has posted
after his training.
This week, Mr. Shaked,
who had become something,
of an Israeli folk hero, pre-
sented the court with new
wartime files that identify
John Demjanjuk by name 4
and SS number, but show he
was transferred to Sobibor
on March 26, 1943, and theili
to Flossenburg on October
10 the same year. 40
He said he had discovered
no new evidence to cor-
roborate the charge that Mr.
Demjanjuk had been at "1
Treblinka.
•
At the start of the hearing
on Monday, Mr. Demjanjuk —
was brought into court in a
wheelchair, groaning and
apparently in pain from a
back injury that had been
aggravated by the bumpy
40-mile ride from his prison
cell.

s—I

He initially refused to _
wear the headphones that
carried a simultaneous
translation of the pro-
ceedings in Ukrainian, but
after being given pain-
killers, he used the heap '
phones to follow the five .-iidi
hour hearing.
The Supreme Court may 4
take several months to con-
sider its verdict. El
