It is the third unsuccessful prosecution by the depart- ment's war crimes unit since it was established by Parliament in September 1987. Mr. Pawlowski, a naturalized Canadian living since 1951 in Renfrew, On- tario, was charged on Dec. 15, 1989 with eight counts of war crimes and crimes against humanity. The charges were based on Mr. Pawlowski's in- volvement in the 1942 kill- ings of 410 Jews and 80 Poles in the Minsk region of Nazi- occupied White Russia (now known as Belarus). At the time, he was a local policeman. The case was crippled by a ruling last May against a government request to send a commission to the Soviet Union to gather and videotape testimony from elderly witnesses unable to come to Canada to testify. Justice James Chadwick, a judge of the Ontario Court, General Division, ruled twice that videotaped evidence could jeopardize Mr. Pawlowski's right to a fair trial. On Feb. 6, the Supreme Court of Canada denied fed- eral prosecutors leave to ap- peal the pretrial ruling. A witness who would have given critical testimony in- volving the massacre of 80 Poles and eight Jews in the village of Yeskovichi died last May. The decision to stay pro- ceedings rather than drop the charges altogether means the prosecution could be reopened if new evidence arises, however unlikely that may be. Mr. Pawlowski broke his silence in the case briefly outside court after the charges were stayed. "I feel great because I was innocent at the beginning, and for two-and-a-half years I have suffered, for what?" he ask- ed. "That's really shameful." Mr. Pawlowski's lawyer, Donald Bayne, said there never was a case against the retired carpenter, only fab- ricated evidence invented by the KGB to frame the former anti-Communist fighter. New Foreign Minister Is More Pro-Arab Brussels (JTA) — Belgium's new foreign min- ister, Willy Claes, is likely to be more pro-Arab than his predecessor, Mark Eyskens, according to informed sources. Mr. Claes' views are said to be influenced by his long association with Algeria, which is considered the most radical of the former French North African states. Mr. Claes was vice prime minister and minister of economic affairs in the government of Wilfried Martens, who was prime minister for 12 years. The new foreign minister, who belongs to the conser- vative wing of the Flemish Socialist Party, is expected to make some changes in Middle East policy, though not fundamental ones. He visited Israel only once, a long time ago, sources said. Another Belgian official said to have Arab connec- tions is Robert Urbain, min- ister of foreign trade in the former government who re- tains that portfolio in the new regime and has also been put- in charge of Euro- pean affairs. Mr. Urbain is particularly friendly with Libya, a coun- try he visited. Mr. Eyskens, who is said -to be sympathetic to Israel, suf- fered political damage last year when it was revealed that an official of archter- rorist Abu Nidal's group entered Belgium with the Foreign Ministry's approval. Mr. Eyskens maintained he was not aware of the ter- rorist's presence on Belgian soil. Belgium's new coalition government of Socialists and Christian Democrats was formed after more than 100 days of political crisis. The parliamentary elec- tions held last November were a setback for the tradi- tional parties. The electorate sent them a protest message by casting an unusually large vote for environmen- talists and the extreme right wing.
