five-year fight over

development of one of
West Bloomfield
township's most valuable
parcels of land ended recent-
ly as litigation against the
township was dropped.
The land in question sits at
the northwest corner of 14
Mile and Orchard Lake
Roads, currently the site of a
golf driving range. Investor
Robert Sosnick had proposed
development of a multi-use
commercial and office com-
plex with a hotel.
A few months ago, Mr.
Sosnick abandoned his plans
to develop the land. But he
had been part of an ongoing
lawsuit in which the de-
veloper claimed he had been
unsuccessful in attempts to
secure zoning changes to
build on the site.
The developer had asked
the Oakland Circuit Court to
declare invalid the
township's zoning or-
dinance, which calls for a
planned development
district in that area — which
is zoned single family
residential.
Since, the lawsuit has been
dropped, and the land re-
mains with the Charles B.
Bauervic Trust. Jerry Fann-
ing, an attorney represent-
ing the Bauervic family, said
the family has not decided
what it will do with the land.
"The family members and
all of the owners are talking
about marketing the proper-
ty," Mr. Fanning said. "We
are re-evaluating our
plans."
Meanwhile, township offi-
cials are thrilled that the
litigation finally has
stopped. Hoping to keep the
area the site of residential
development, Supervisor
Sandra Draur is calling the
withdrawal of the lawsuit a
township "victory."
Ms. Draur said the
township amassed legal fees
from the lawsuit in excess of
$250,000.
"We felt very strongly
about maintaining that
piece of property. I'm very
pleased to see that the
lawsuit was dropped," Ms.
Draur said. "It was a major
expense for the township."
In West Bloomfield, slow
growth advocates have
blamed developers for
creating a mess. West
Bloomfield is a high priced
real estate mecca still ex-
periencing growing pains.

A change in makeup on
the township board leaves
slow growth advocates con-
trolling the majority of seats
on a seven-member council.
In the past few years, the
board has passed a number
of building moratoriums and
restrictive environmental
ordinances. Downzoning has
become synonymous with
protecting the residential
aura.
The fight to develop sec-
tion 34 — the land at Nor-
thwestern and 14 Mile roads
— dates back to 1986, when
Mr. Sosnick first asked the
township to rezone the land..
The Bauervics now must
decide what to do with the
land. Mr. Fanning said the
family has not yet estab-
lished a price for the land if
they decide to sell. Mr.
Sosnick had a contingent
contract that was subject to
the rezoning of the land, Mr.
Fanning said. -
"We will meet with the
family (Bauervic) and review
the whole situation in light
of present day conditions,"
Mr. Fanning said. "With all
of the overbuilding, there
has been a depressed real
estate market. There is a
question as to how great the
demand is at the mo-
ment." ❑
