Tel Aviv (JTA) — A Tel
Aviv court is now grappling
with Israel's first major
"right-to-die" case.
Benny Eyal, 50, who is in
the advanced stages of mul-
tiple sclerosis, an often
degenerative disease of the
central nervous system,
petitioned the district court
to order his doctors to refrain
from putting him on a life-
support system when he goes
to the hospital. He is
presently living at a nursing
home.
Mr. Eyal, whose wishes
are supported by his wife,
told the court he preferred to
die with dignity than be kept
alive by artificial means and
in distress.
His case is the first in
Israel that would have doc-
tors accede in advance to
such a request.
But Attorney General
Yosef Harish said this week
that there were no legal
means by which he could
obligate doctors "not to act
in accordance with the law
and the medical, moral, hu-
manitarian situation at the
given moment."
Tel Aviv's chief rabbi,
Israel Lau, who was visibly
uncomfortable with the
situation during a television
interview, said Halacha, or
Jewish law, insists that
every effort must be made to
keep a human being alive,
even for a very short time
and even in distress.
Mr. Eyal, who is complete-
ly paralyzed, can move only
his eyes and speaks with
great difficulty, was shown
on the same television pro-
grani being helped to put his
thumb print on his request
to the court.
Rubinstein Gets
Legal Post
Jerusalem (JTA) —
Elyakim Rubinstein, an Or-
thodox Jew considered polit-
ically to the right of center,
was appointed deputy at-
torney general, a newly cre-
ated position regarded as a
steppingstone to the High
Court of Justice.
Mr. Rubinstein, 39, is
presently the Cabinet secre-
tary. His nomination to the
new office was approved last
week by the Cabinet.
Justice Minister Dan Me-
ridor is said to have imposed
him on a reluctant attorney
general, Yosef Harish,
whom Rubinstein is ex-
pected to succeed. Harish,
68, intends to remain in of-
fice until he is 70.
