Canadian Court Upholds
Freedom Of Observance

Montreal (JTA) — The
Canadian Supreme Court, in
a unanimous decision, has
upheld the right of a re-
ligiously observant person to
take religious days off from
work without jeopardizing
his employment.
The ruling overturned
previous decisions, including
judgments by two Alberta
courts and a previous related
decision by the Ottawa court
itself.
The complainant, Jim
Christie, is a member of the
Worldwide Church of God, a
Christian denomination that
observes the Sabbath on
Saturday, similar to the
Jewish tradition. It also
observes other religious days
in which, as in Judaism,
work is not performed.
In 1983, Mr. Christie was
fired from his job at the Cen-
tral Alberta Dairy Pool, a
milk-producing and process-
ing company, because he
stayed away from work on a
day of religious observance.
The Alberta Human
Rights Commission, which
held an inquiry, maintained
that discrimination existed
in the case.

argued that "regular atten-
dance at work, in accordance
with an established work
schedule, was a bona fide oc-
cupational qualification"
under the province's human
rights legislation, which
took precedence over an
employee's hardship.
Justice Bertha Wilson of
the Supreme Court ruled
that "the onus" rests with
the employer "to show that
it made efforts to accom-
modate the religious beliefs
of the complainant up to the
point of undue hardship."
The Canadian Jewish
Congress, which had
intervenor status in the
case, hailed the decision as
"one additional step on the
way to protecting Canada's
minorities."
According to Joseph
Wilder, chairman of the
CJC's National Joint Com-
munity Relations Com-
mittee, "it will no longer be
possible for employers to use
economic regulations, like
hours and days of work, to
trample over the minority
religious beliefs of their
employees."

Jerusalem (JTA) — Ethio-
pian Jews held a turbulent
demonstration last week
outside the Prime Minister's
Office, demanding swift
government action to bring
family members still in E-
thiopia to Israel.
Some demonstrators
knocked down a police bar-
rier and tried to rush the
building. The police used
force to disperse them.
The protest began quietly.
But emotions were aroused
when one man, sobbing, told
the crowd over the public
address system how much he
missed his mother, whom he
left behind when he came to
Israel.
Adisso Messala, chairman
of the organization of Ethio-
pian Jews in Israel,
declared, "We are sick and
tired of our image as quiet,
disciplined citizens."
Israeli immigration agen-
cies do not deny that the
situation is worsening for
the thousands of Ethiopian
Jews stranded in Addis
Ababa, the capital, who are
waiting to emigrate.

At least 100 of them are
reported to have died in re-
cent months.
But Jewish Agency and
Absorption Ministry officials
blame the Ethiopian
government for holding up
emigration. The Ethiopian
authorities committed
themselves to 500 immi-
grants a month but are
withholding passports, the
officials said.
There is concern in Addis
Ababa, they said, that once
all the Jews have left, Israel
will no longer provide Ethi-
opia with the arms and am-
munition it wants.
The sources told Israel
Radio that "each demonstra-
tion against the Israeli
government encourages the
Ethiopians to squeeze more
benefits for allowing local
Jews to go."
Meanwhile, the Israeli
government, the Jewish
Agency and the American
Jewish Joint Distribution
Committee are expending
considerable money and
efforts to improve conditions
