binical court and says he is
Jewish, should he be believ-
ed? Although some rabbis
argue that such a declara-
tion should be believed,
former Sephardi chief rabbi,
Ovadia Rabbi Yosef, told the
conference that the immi-
grant must prove that he is a
Jew.
The best way to do this, he
said, was to bring witnesses
to attest to his Jewishness. If
this is impossible, he said,
the immigrant should
undergo conversion.
Rabbi Shilo Rafael, head of
the special Jerusalem rab-
binical court that deals with
divorce cases, suggested an-
other option. He said that
immigrants bearing a Soviet
birth certificate issued
before 1985 should be
believed. In Soviet birth cer-
tificates, the nationality of
the person's mother and
father is listed. Prior to
perestroika, Rabbi Rafael
said, no non-Jew claimed to
be a Jew.
Several rabbis also touch-
ed on the question of
whether a Soviet woman
who was married in a civil
ceremony needs a divorce
certificate, get, before
remarrying in Israel. Rabbi
Essas estimated that, among
the immigrants, one in every
three women between the
ages of 30 and 50 have been
divorced at least once.
"One in every two mar-
riages there ends in
divorce," he said. "And the
Jews are not that different."
The reason for this, he
said, is the relative ease of
getting married — and
divorced — in the Soviet
Union. Up until 10 years
ago, divorce did not entail
any court procedures. In ad-
dition, since few people have
many possessions, an ugly
settlement battle is not a
disincentive to divorce.
"All they have to argue
over is one television,"
Rabbi Essas said.
As a result, thousands of
divorced women are arriv-
ing, without a get. In many
cases they haven't seen their
ex-husbands for years. If the
rabbinical establishment
demands a get from every
woman, scores will be
unable to remarry, Rabbi
Yosef said. Therefore, he
said, the rabbinical courts
should try to be lenient in
these cases.
There is room for leniency
if a woman married a
"devout communist," he
said, since the man is con-
sidered an "apostate," and
the marriage vows of an
apostate are not binding.
"We need to respect the
immigrants, encourage
