I NEWS I Father Gets Sympathy For Child Abduction Toronto (JTA) — A Toronto district judge has indicated sympathy for a Canadian Orthodox Jew who fled to Israel with his toddler son in 1987, after discovering that the child's mother who had legal custody was a member of Jews for Jesus. Judge David Humphrey ruled that while the defen- dant, Meir Avitan, was "clearly guilty of abducting the child," he would acquit him of breaching a court order which forbade him to remove the child. Avitan, who pleaded not guilty to the abduction charge, said he discovered late in 1986 that his former wife was taking the then 7- month- old boy, Daniel Michael, to Christian ser- vices. Avitan and his wife, Ken- dra, were married in 1986 and separated four months after the birth of their son. According to Avitan, his wife promised in writing to raise the child in the Jewish faith and feed him only kosher food. But she violated the separation agreement, he contends. In March 1987, he took Daniel to Israel despite a court order. Kendra Avitan does not feel she breached their agreement. She said she converted to Judaism and is still a Jew and a member of Jews for Jesus. She followed her former husband to Israel, where the courts ruled that the child should be returned to his mother. In April 1987, she flew back to Canada with the boy. But Judge Humphrey said there was no proof that Avitan knew of the court order until he was in Israel with the child. Canada Begins I st Nazi Trial Toronto (JTA) — The first Canadian trial of a suspected Nazi war criminal opened in Ontario Supreme Court on Nov. 22. The defendant, Hungarian-born Imre Finta, 77, has been indicted on four charges of crimes against humanity and four counts of war crimes for confinement, kidnaping, robbery and man-slaughter. The trial is the first held under a 2-year-old amend- ment to the Criminal Code, which gives Canadian courts jurisdiction in crimes com- mitted on foreign soil.
