Chief Justice Meir Sham- gar and Aaron Barak, both former government legal advisors, are the leaders of the activist wing. Barak, at 53, the Court's youngest jus- tice, is considered a brilliant jurist who helped draft the Camp David Accords. Since coming to the court, he has introduced the test of reasonableness for govern- ment actions. In a landmark decision, he ruled that the Military Censor acted un- reasonably in restricting publication of an article by a lel Aviv newspaper that dealt with the former head of the Mossad, Israel's secret intel- ligence agency. In doing so, he considerably widened the scope- of the bagatz system, and tightened restrictions on the administrative power of government agencies. Unlike the United States, Israel has no written consti- tution, and the Court cannot rule legislation unconstitu- tional. In theory, the Knesset is sovereign to decide what it likes. But over the years, the Court has found ways to exer- cise a form of judicial review. In a recent case, for exam- ple, Chief Justice Meir Sham- gar ruled that the law which grants client privilege to lawyers and doctors must ex- tend to journalists and their sources. In doing so, Shamgar extrapolated from the unwrit- ten principles of Israeli democracy, which includes freedom of the press, to go beyond the letter of the law. "What he was actually doing was making law," says Schoff- man. Blum agrees. "The court sometimes comes very close to making legislation." he says. Sometimes the mere threat of a bagatz is enough to get action. Recently the Associa- tion for Civil Rights filed a petition with the court re- garding the abysmal condi- tions in a military prison. The army responded by making drastic improvements. A delegation of three Supreme Court Justices then visited the prison to inspect the changes. Satisfied, the Association dropped its peti- tion. "The Court sometimes disappoints us," says Joshua Schoffman, "but most of our successes come through peti- tioning it, or threatening to." The range of the Supreme Court is virtually limitless.
