However, that deal will fall through if Gotham Tower does not fulfill the land con- tract conditions to the school board's satisfaction. In addition to the contract dispute between Gotham Tower and the school board, yeshiva officials are con- cerned about removing asbestos • from the school building. - The yeshiva was one of two area schools informed last month by the U.S. Envi- ronmental Protection Agen- cy (EPA) that it faces a possible $4,000 fine for violating asbestos rules. The EPA had not received a management plan required from all elementary and secondary schools that shows the agency how much of the suspected carcinogen is in the building-and what the school plans to do about it. However Rabbi Rushnawitz said ' everything has been settled and the yeshiva will not be fined. The plan is on its way to the EPA. The Yeshiva discovered it had two minor asbestos problems in the boiler room. A door must be installed in a boiler room tunnel and some small pipes have to be covered to fix the asbestos problem, Rabbi Rushnawitz said. Last week, the school board passed a resolution telling Gotham Tower, which owns the yeshiva and surrounding area at 24600 Greenfield Rd., to pay the money it owes the board, said school superintendent Leonard Demak. Although Gotham Tower has paid the interest on the land contract, it has not paid the taxes or the principal money it owes the board for a year-and-a-half, Demak said. He would not say how much , money Gotham owes the board except that is a "substantial amount." If Gotham Tower does pay the debt, the board must consider its options, he said. It could declare Gotham Tower has forfeited its land contract and the property would revert back to the board. However, Gotham Tower President Lorraine Golden said the company "fully in- tends to make the payment. We just needed to work some details out with the tenant in the building and the school." Gotham Tower got behind in the payments last year when it was not notified by the school board that money was due, Golden said. When it received the bill this year, the company wanted to work out a way to pay the entire bill faster.
