ADL Appeals
Omaha Case

New York — The Anti-
Defamation League has ask-
- ed the U.S. Supreme Court to
declare the Equal Access Act
(EAA) unconstitutional
becaue it "sanctions the use
of public school facilities to
advance religion in violation
of the First Amendment."
In an amicus curiae brief
filed in "Board of Education
of the Westside Community
Schools (District 66) v.
Bridget C. Mergens," ADL
supported the refusal of
Westside High School in
Omaha, Neb.; to sanction a
student Bible club on the
school's premises. The ADL
brief noted that the Bible
club's founder, Bridget C.
Mergens, had testified that
one of the reasons she
organized a Bible club at
Westside was to "promote
Christianity to non-religious
students at her school."
In its decision in the case
now under review, the U.S.
Court of Appeals for the
Eighth Circuit cited the
Equal Access Act in ruling
that so long as student groups
not connected to the school's
curriculum are permitted to
meet at the school, then stu-
dent religius groups must
also be allowed to use the
facilities.
Justin J. Finger, ADL's
associate national director,
declared, however, that by ap-
plying the EAA in this case,
the Court of Appeals required
Westside High School "to for-
mally endorse sectarian ac-
tivities."
