The illustrations of mutual
integrity between God and
the hero present a fortiori
arguments. If we who are
created in His image are en-
couraged to question God and
to assume our responsibilities
in our acting, how much more
are we responsible for actions
when they are ordained by
mere flesh and blood
superiors?
Consonant with the respon-
sibility placed on the in-
dividual, the rabbinic tradi-
tion raises the individual con-
science above conformity to
the majority. One is to incline
towards the majority but not
to follow a majority for evil.
(Exodus 23.2) The celebrated
deference which is accorded
the superiors of the judicial
court must not be allowed to
still the dissent of the disci-
ple. Maimonides in his Mish-
nah Torah (Sanhedrin 22)
writes, "If a disciple sitting
before his master sees a point
in favor of a poor man and
against a rich man and re-
mains silent, he violates the
command "Ye shall not be
afraid of the face of any man!'
The Judaic hero, patriarch,
soldier, officer of the court,
everyman is informed by the
indefeasible spirit of pro-
phetic criticism and con-
science. It expresses an heroic
ideal essential to a
democratic society forever
tempted by the seductions of
the Grand Inquisitor.
Elie Wiesel has observed,
"Nothing has been learned.
Auschwitz has not served as
a warning. For further infor-
mation consult your daily
newspaper." The Nuremberg
mentality is widespread and
its consequences are chilling.
The plot to create "off the
shelf, self-sustaining, stand
alone" entities within the
government that could per-
form covert activities in viola-
tion of the will of the people
(according to North's own
testimony) depends on good
soldiers forever doing their
job in obeisance. But if good
soldiers agree with the orders,
they ought not claim exemp-
tion from culpability; if they
disagree, patriotism requires
them to blow the whistle in .
defense of country.
"Whoever can remonstrate
against the trangressions of
his household and does not, is
held responsible and pun-
ished for those transgres-
sions; whoever can remon-
strate against the transgres-
sions of his fellow townsmen
and does not is seized for their
transgressions; whoever does
not remonstrate against the
transgressions of the whole
world is seized for their tran-
sgressions!" (T. Sabbath 54b)
(T. Avodah Zarah 18A)
