ceedings are of public record.
In contrast, the single parent
trust is settled with court pro-
ceedings, the process is
quicker, more private and
avoids legal fees, court costs,
and the frustrating delays of
Probate Court.
• One of the most impor-
tant advantages of a single
parent trust is that the
parent can control when the
receive
children
disbursements, the amount
they are to receive and who
shall retain control of the
funds. The trust can retain
the assets invested until the
reach
beneficiaries
designated ages when partial
disbursements can be made
thereby holding off sizeable
amounts of cash being placed
at the disposal of an 18-year-
old (age of majority in
Michigan) which is what hap-
pens when there is only a
will.
• The trust may be chang-
ed or revoked entirely at any
time by the parent. Assets
may be added to the trust,
withdrawn or sold. However,
once the owner dies no one
else can change or revoke the
trust.
• In the single parent trust,
the owner can name a guar-
dian to manage the affairs in
the event the owner is ever
legally declared incompetent;
without the trust the court
can appoint a guardian
thereby frustrating the
desires of the parent who
would have chosen a different
guardian.
Disadvantages of a single
parent trust are relatively
few. Basically there is the in-
itial inconvenience of
transferring accounts and
titles of property into the
trust. Occasionally, in the
case of refinancing real
estate, some institutions may
require the property be
transferred out of the trust
prior to receiving a mortgage,
however, once the transaction
is completed the home may be
transferred back into the
trust.
The costs of a single parent
trust are relatively small
when compared with the
financial gain and peace of
mind gained by proper plan-
ning. The single parent trust
is a tool for good financial
planning and protection of
assets for the benefit of
children. It can be useful for
all single persons who have
acquired assets whether they
be widows, divorcees, or
unmarrieds.
