regarding religion and the
state which were given when
Israel was established and
which had firm antecedents
in the Mandatory period.
In the late 1940's, David
Ben-Gurion (no religious Jew
by any stretch of the imagina-
tion) gave written assurances
to the Agudah and Mizrachi
Orthodox parties regarding
the Sabbath, matters of per-
sonal status (including mar-
riage and divorce) and several
other matters in what came
to be known as the Status
Quo Agreement-. Ben-
Gurion's motive was two-fold.
He wanted to promote the
- unity of the Jewish people
and to preserve in some
measure the Jewish character
of the Jewish state.
It is extremely significant
that the Sabbath and per-
sonal status, the principal
cornerstones of the Status
Quo, are also the major issues
these days in secularist-
Orthodox conflict.
Although the concept of the
Status Quo presupposed a
static arrangement regarding
' religion, as time went on and
conditions changed, there
would have to be changes in
its scope and effectiveness. By
far, the greatest changes in-
dicate a decline in the role of
religion, which reflects the
growing secularization of the
. Israeli public, especially the
Sephardic element, during
the past forty years.
The current resistance to
showing movies on the Sab-
bath in Jerusalem and earlier
in Petach Tikvah has been
aimed at restoring the status
quo ante religious bellum in
which movie houses were not
permitted to open on the Sab-
bath. Even the effort to
amend the Law of Return is
linked to the Orthodox deter-
mination to return to the
original understanding that
halacha would govern in all
matters of personal status.
By battling on these fronts,
however, the Orthodox in-
evitably further the percep-
tion that it is they who are
trying to change the rules of
the game, that it is they who
want to alter the Status Quo.
However the Orthodox are
viewed by other Jews, they —
including the ultras — are
entitled to the civil rights
which minorities must enjoy
in a democratic society. The
violation of these rights in re-
cent weeks is a disturbing
development.
. They have the right, first of
all, to demonstrate on behalf
of Sabbath observance or any
other religious observance
