"As lead counsel, I felt it
incumbent on me, in the
process of being discharged of
responsibility for John's life,
that he at least be informed
by the court — and not by
Yoram Sheftel (his Israeli
assistant) — as to what he
has to look forward to once I
have left the defense team."
The sacking has indeed
come at a critical juncture in
the five-month-old trial —just
two weeks before the opening
of the defense case on July 27
when Demjanjuk himself
must take the stand.
Under Israeli law, an ac-
cused cannot dismiss his
counsel during a trial
without the consent of the
court, and the judges quickly
announced that they would
indeed convene in special
session on Wednesday to
consider O'Connor's
dismissal.
The firing of Mark
O'Connor has brought to a
head the long-festering
wrangle within the three-
man defense team,
particularly
between
O'Connor and Sheftel.

Several months ago,
O'Connor attempted to sack
Sheftel, but the Demjanjuk
family objected. Instead, it
was O'Connor — reputed to
have exercised an almost
Svengali-like influence over
Demjanjuk, his wife, son and
two daughters — who ulti-
mately got the bullet.
Nor can O'Connor draw
much comfort from the third
member of the defense team,
John Gill, of Cleveland, Ohio,
who had won a place on the
team because of his expertise
in documents.
O'Connor was fired, Gill
confirmed to reporters from
his home in Cleveland this
week, because Demjanjuk
was dissatisfied with his
handling of the case and
because of O'Connor's
relationship with the
Demjanjuk family.
To add to the drama,
O'Connor, who still considers
himself to be Demjanjuk's
attorney, has threatened to
"tell all" if he loses his bid to
stay on as chief defense
counsel after the three judges
have had the final word.

O'Connor Accuses His
Assistant Of Duplicity

In his letter to Presiding
Judge Dov Levin, dated July
11, O'Connor accused his
Israeli assistant, Yoram
Sheftel, of duplicity, in-
competence and theft.
He alleged that Sheftel had
engineered his ouster, infer-
ring that Demjanjuk had
been duped into signing his
letters of dismissal by his son,
John Demjanjuk Jr., who was
inspired by Sheftel.
"My client, John Demjan-
juk, yesterday informed me
that he had been persuaded
by my assistant, Yoram
Sheftel, and his son, John Jr,
to sign two documents.
"Mr Demjanjuk appeared
confused and uncertain as to
the reasons he had to sign
these documents and the con-
squences of his actions,"
O'Connor said in his letter.
"His son had been assuring
him, however, that it was the
right thing to do and not to be
concerned."
The Israeli attorney, O'Con-
nor continued, lacked "in-
depth understanding of this
complicated international
proceeding."
"I informed the family and
Mr Demjanjuk long ago of my
decision to replace Mr Sheftel
due to his unacceptable line
of defence in the case," wrote
O'Connor. "The family,
however, determined to rehire

him and retain his services as
their personal attorney in
this matter.
"Mr Demjanjuk's apparent
decision to consent to the
families (sic) choice in this
regard, if it was an informed
consent, will of course, be
respected by me.
"I believe it only fare (sic),
however, that Mr. Demjanjuk
be advised directly of the
court's recent ruling that due
to the late stage of the trial,
no additional time can be
allocated for the family to
seek further opinions in the
case."
He went on to accuse
Sheftel of travelling secretly
to Cleveland, Ohio, where the
Demjanjuk family lives, and
later to Belgium — infor-
mation O'Connor said he had
received from the prosecution
counsel Michael Shaked.
Shaked, he added, "was
also informed concerning the
current status of the Demjan-
juk family fund-raising ef-
forts."
"I was forced to call the in-
chamber session in which Mr
Shaked appeared more in-
formed about Mr Sheftel, his
whereabouts and recent
defence strategy, than anyone
in the room or even Mr
Sheftel's own secretary."
He also charged that
Sheftel and Shaked had
