New York (JTA) — The
New York Supreme Court Ap-
pellate Division ruled last
week that an agreement in
which a spouse threatens to
withhold or indeed withholds
a Jewish religious divorce to
pressure a partner into finan-
cial concessions is subject to
review and revision in court.
The decision reversed a ril-
ing by the Supreme Court of
New York County not to
recognize Chana Perl's claim
that she was coerced into giv-
ing her ex-husband $35,000
worth of cash and assets
under his threat of with-
holding the religious divorce,
or "get." The agreement was
made after the Perls, who are
Orthodox Jews, had divorced
under civil law.
Accordingto Jewish law, a
divorced woman cannot
remarry without a get, and
any children by the couple are
considered illegitimate. A
civil court cannot order a man
to give his wife a get, and
Jewish scholars have noted

that get-coercion is not un-
common.
Mrs. Perl claimed her ex-
husband forced her to re-
linquish her interest in their
home, her car, her personal
jewelry and more than
$70,000 in cash, checks and
securities. She had agreed to
relinquish the money and
assets in an oral statement in
civil court which stipulated
that Mr. Perl would be
obliged to give her a get
within 10 days.
He gave the get shortly
thereafter, but Mrs. Pert stop-
ped payment on checks worth
$34,000, claiming she had
been coerced into signing the
agreement under his threat of
withholding the get.
Mr. Perl then sued to col-
lect payment on the $34,000.
The lower court dismissed
Mrs. Perl's defense of duress
and coercion and her counter-
claims.
The appellate court ordered
a trial on both parties' claims
and counterclaims.
