State Sued On
Kosher Law

Staff Report

A lawsuit filed in Oakland
County Circuit Court last
Friday against the Michigan
Department of Agriculture is
designed, according to attor-
neys for the plaintiffs, to
force the state to supervise
the sale of kosher meat in
Michigan.
Mark Schlussel and Eli
Kaplan are representing Sol-
omon Frankel, Jeffrey Perls-
tein and Chayim Silverstein
in the suit, but the group has
been working with the Coun-
cil of Orthodox Rabbis of
Greater Detroit on the case.
Schlussel and Kaplan told
The Jewish News that the
current kosher law in Michi-
gan is a criminal statute.
"The rabbis can determine
the religious requirements of
kashrut," Kaplan said, "but
they can not enforce the law.
We believe the Department of
Agriculture has the power to
enforce."
At present, the rabbis
withdraw their certification
of an establishent when their
kashrut standards are not
met.
Schlussel said the state has
20 days to respond to the suit
and "I am hopeful the state
would see this as an opportu-
nity to sit ,down with us and
discuss this issue." The case
has been assigned to Judge
John O'Brien. Delays may
occur if the state seeks to
negotiate.
The attorneys and their
plaintiffs would like to see
New York State used as a
model by Michigan. In New
York, a separate kosher
enforcement division has the
power to investigate and con-
fiscate suspected foodstuffs
and run _chemical tests on
products.
The case is an outgrowth of
an incident at Bernard & Son
kosher meat market in Far-
mington Hills in July, in
which non-kosher meat was
alleged to have been found in
the store and the Council of
Orthodox Rabbis removed its
certification.
