ow oil pm im • so on we on I= ow NE al COUPON] Super Special —1 Restrictive Clause Amazes' Rehnquist Washington (JTA) — U.S. Supreme Court Associate Justice William Rehnquist told > the Senate Judiciary Committee which last week ended a hearing on his nomination to head the Supreme Court that the deed to his summer home in Greensboro, Vermont, contains a clause for- bidding it from being leased or sold "to any member of the > Hebrew race." But Rehnquist, who has been nominated by President Reagan N., to become Chief Justice of the /) United States, maintained that he did not know the restrictive covenant existed until lately, > although he had owned the home since 1974. He said he was "amazed" when he found out about it following an FBI > investigation. The deed restriction was revealed by Sen. Patrick Leahy (D., Vt.) during Rehnquist confir- mation hearing before the Senate Judiciary Committee. Leahy said he was suprised that Rehnquist had not noticed the restriction since the deed was a standard printed "boiler- plate" document with only the description of the property and the restriction typed in. Rehnquist said the restriction was "obnoxious." But at first he rejected as unnecessary Leahy's suggestion that it be removed. Rehnquist said there was no point since such discriminatory clauses were illegal under federal law. Leahy added it was also il- legal under Vermont law. But after Leahy suggested that it would not look good for a Chief Justice to have such a restriction on property he owned, Rehnquist said "if there's a procedure under Vermont law where one could void it or get rid of it, I- would certainly go through it." Civil rights and women's or- ganizations are opposing the Rehnquist nomination because they charge he has been dis- criminatory toward Blacks and • other minorities and women.
